Patent violation suit By Akzenta against Egger dismissed

Jul 06, 2009. /Lesprom Network/. Akzenta filed a patent violation suit against two EGGER companies with the Düsseldorf District Court in June 2008. The company Akzenta was of the opinion that a particular EGGER process for the installation of laminate flooring violated its own patented installation process. In its decision dated 15th June 2009, the court dismissed the suit, Wood Panels Online informed.
In the reasons for its decision, the court clearly specified that the EGGER installation process does not violate the Akzenta patent.
The suit was based on the German section of the European patent EP 1 200 690 (also known as the "torsion patent" among experts) of Akzenta Paneele + Profile GmbH, which was issued on 03rd March 2004. It protects a special installation process for flooring panels. However, the court is of the opinion that this process differs from the EGGER method in several ways. The decision is of particular relevance for hard floor coverings that can be installed without the use of glue and are connected to each other by tilting. The EGGER process itself is protected by the European patent EP 1 793 065.
"We welcome this decision. It fully conforms to our expectations," commented Stefan Pletzer, Sales and Marketing Director EGGER Retail.
The decision is not yet legally binding and still subject to appeal.
