The Federal Court in Espírito Santo issued an injunction on granting Aracruz the right to repossession of its lands invaded by representatives of indigenous communities in its region in Espírito Santo since Tuesday, May 17. The Court also determined that agents of the Federal Police accompany a Court Official to the location of the invasion to ensure compliance with the court order.
In view of the invasion of its property, Aracruz notified the National Indian Foundation (FUNAI), the Tupinikim Indigenous Association of Comboios (AITC) and the Tupi-Guarani Indigenous Association (AITG), declaring the invasion to be a violation of the right to property and that the company had decided to suspend compliance with the obligations under the Term of Conduct Adjustment signed with the indigenous communities on June 30, 1998.
In its notification, Aracruz stated that once the hostility has ended, it will not shirk from any dialogue designed to reestablish the original conditions of the agreement.
Since it took effect, the agreement — whose conditions were revised in 2002 — has generated disbursements on the part of Aracruz to the indigenous population of some 2,000 persons of about R$23 million.
Besides direct payments, Aracruz also has been contributing to the development of the indigenous communities through voluntary actions, commercial wood purchase contracts, scholarships for indigenous university students, technical orientation for farming activities and other actions that seek to contribute to the generation of jobs and income.
