(SWM) responded to the anticipated decision rendered on June 5, 2012 in the International Trade Commission (ITC) action filed by SWM under Section 337 (b) of the Tariff Act of 1930, as the company said in a press release received by Lesprom Network. The full ITC reviewed the initial decision issued by Administrative Judge Gildea and decided to terminate the investigation with a final determination of no violation of section 337. The Commission's notice provided no reasoning for its final determination and did not indicate if a full opinion will be issued. Frederic Villoutreix, CEO, commented, "The notice of the ITC's final decision gives no indication of the basis for its finding of no violation. We will make a final decision on next steps once we better understand the basis for the final determination. As we noted previously, we believe that the initial decision's findings on the questions of patent validity and infringement are not consistent with established case law and were based on appealable error."
